§ 3-5. Same—Birds protected.

  • It shall be unlawful to trap, shoot, hunt, or attempt to shoot or molest in any manner any wild bird or wild fowl or to rob wild birds' nests or wild fowl's nests; provided, however, if starlings or similar birds are found to be congregating in such numbers in a particular locality that they constitute a nuisance or menace to health or property, a complaint may be made to the chief of police, and after such complaint being made, the chief of police shall forthwith investigate the complaint and if deemed that such birds are a nuisance or menace to health or property, the chief may direct and supervise a means for their destruction. The destruction of such birds shall be made only under the direct supervision and control of the chief of police.
